  • Submit false, misleading or fraudulent inquiries.
  • Use automated tools to scrape, extract or collect website content without permission.

We reserve the right to restrict access where misuse or suspicious activity is identified.

3. Project Inquiries

Submitting a contact form, project inquiry, email or other communication does not automatically create a client-consultant relationship or contractual obligation.

A project becomes subject to commercial terms only after the appropriate scope, deliverables, pricing, timelines and other requirements have been mutually agreed.

We may accept or decline project inquiries at our discretion.

4. Proposals, Quotations and Scope of Work

Any proposal, estimate or quotation issued by The NxtGen will be based on the information available at the time it is prepared.

Project fees, timelines and deliverables may change if:

  • Project requirements change.
  • Additional services are requested.
  • Incomplete or inaccurate information is supplied.
  • Design revisions materially affect the agreed scope.
  • Project schedules or coordination requirements change.
  • Additional drawings, models or deliverables are required.
  • Third-party dependencies cause changes to the project.

Any material changes to the agreed scope may require additional fees, revised timelines or a formal change request.

5. Client Responsibilities

For professional BIM and engineering services, clients are responsible for providing accurate and timely project information reasonably required to perform the agreed services.

This may include:

  • Architectural drawings
  • Structural drawings
  • MEP drawings
  • Point-cloud or survey information
  • Design specifications
  • BIM Execution Plans
  • Project standards
  • Families, templates and naming conventions
  • Existing models
  • Design revisions
  • Coordination information
  • Client comments and approvals

Delays or inaccuracies in client-supplied information may affect project delivery schedules, outputs and costs.

The NxtGen is not responsible for issues caused directly by incomplete, outdated, incorrect or conflicting information supplied by clients or third parties.

6. BIM Models and Digital Deliverables

BIM models, drawings and other digital deliverables are developed based on the agreed scope, Level of Development (LOD), project information and available reference documents.

Unless otherwise agreed in writing, BIM models should not be assumed to contain information beyond the explicitly agreed project requirements.

Digital models may be created for purposes such as:

  • Design coordination
  • Clash detection
  • Construction coordination
  • Visualization
  • Documentation
  • Shop drawing preparation
  • Quantity-related workflows
  • Existing-condition documentation
  • Asset information

The suitability of a model for a particular downstream purpose should be confirmed before relying on it for that purpose.

7. Design Responsibility

The exact professional responsibility of The NxtGen will depend on the scope agreed for each project.

Unless explicitly included in a written agreement, preparation of a BIM model or coordination model does not automatically mean that The NxtGen assumes responsibility for the original architectural, structural, engineering or specialist design prepared by others.

Project designers, engineers, consultants, contractors and other responsible parties remain responsible for their respective designs, calculations, approvals and statutory obligations unless otherwise agreed in writing.

8. Clash Detection and Coordination

Clash detection and BIM coordination are intended to assist project teams in identifying potential spatial or coordination conflicts.

The absence of a reported clash does not guarantee that:

  • No construction conflict exists.
  • A design is technically compliant.
  • A model contains no errors.
  • All installation conditions have been identified.
  • Every site condition has been represented.

Clash detection results depend on the completeness, accuracy and quality of the models and project information provided.

9. Project Changes and Revisions

Projects often involve design development and revisions.

Where revisions fall outside the agreed scope or require substantial rework, The NxtGen may treat those changes as additional services.

Additional work may require:

  • Revised pricing
  • Additional project hours
  • Revised delivery dates
  • Updated deliverables

Major revisions should be documented and approved through the applicable project communication or change-management process.

10. Project Timelines

We aim to meet agreed project schedules, but delivery dates may depend on timely receipt of required information, approvals, decisions and feedback.

Timelines may be affected by circumstances including:

  • Late client inputs
  • Design revisions
  • Third-party delays
  • Incomplete project information
  • Software or platform issues
  • Changes to project scope
  • Events outside our reasonable control

Where delays occur, revised schedules may be communicated as appropriate.

13. Confidential Information

During a project, either party may receive confidential, proprietary or commercially sensitive information.

Where appropriate, such information should be handled in accordance with:

  • Project agreements
  • Non-disclosure agreements
  • Client requirements
  • Applicable confidentiality obligations

Clients should avoid submitting highly confidential project information through a general website inquiry form unless specifically requested.

Where secure document exchange is required, an appropriate project collaboration or file-transfer method should be used.
